1.2. Before placing an order in the electronic store www.quted.com (after this – e-store), it is recommended that you (after this – the Buyer) read the Terms and Conditions (after this – the Terms) in detail. These Terms are a legal document binding on the parties, which establishes rights and obligations of the Buyer and the Seller, the conditions of purchase and payment for goods, the procedure of delivery and return of goods, liability of the parties, and other issues related to purchasing and sale of goods in the e-store.
1.3. The Seller reserves the right to change, amend or supplement the Terms. Therefore it is recommended to get acquainted with the Terms during each purchase. The Terms in force at the time of placing the order always apply to the purchase.
1.4. If the Buyer does not agree with the Terms or a part thereof, he should not order goods in this e-store. By placing an order, the Buyer confirms that he agrees with the Terms.
1.5. The Agreement between the Buyer and the Seller (after this – the Agreement) is considered concluded from the moment when the Buyer has formed a shopping cart in the e-store, indicated the delivery address, selected the payment method, and read the Terms, click the “Proceed to PayPal” button.
1.6. An integral part of the Agreement is the Buyer’s order data: shopping cart, Buyer’s name, e-mail, postal address, telephone number, delivery address, and other data and purchase options provided by the Buyer at the time of ordering.
2. Protection of personal data
2.1. When ordering goods in the e-store, the Buyer must provide the data requested at the time of purchase: name, surname, address, telephone number, and e-mail address.
2.2. The buyer is responsible for providing the correct data at the time of purchase.
2.3. By placing an order, the Buyer agrees that the Seller will process provided personal data for order execution. The Buyer agrees that e-mail specified during the registration/order will be used to receive the information about the order.
2.4. The Buyer’s personal data may be processed for marketing purposes only with the Buyer’s consent.
2.5. Evidence of the conclusion of the contract, i. y., the confirmed order, its content, date and time of submission, details of the payment and invoice made, information on the delivery of the order is stored in electronic format in the Seller’s database.
2.6. The Seller undertakes not to disclose the Buyer’s personal data to third parties, except for the parties providing goods delivery services for the delivery of the order, when required by the competent State authority in cases provided by the laws of the Republic of Lithuania or with the separate written consent of the Buyer.

3. Buyer’s rights and obligations
3.1. The following persons have the right to make purchases in the e-store:
3.1.1. natural persons, i. y. persons who have reached the age of majority and whose capacity is not restricted by judicial procedure,
3.1.2. minors between the ages of 14 and 18 with the consent of their parents or guardians, unless they are self-employed,
3.1.3. legal persons that are acting through authorized representatives.
3.2. When placing an order in the e-store, the Buyer confirms that he meets the conditions specified in clause 3.1 and has the right to purchase in the e-store.
3.3. The Buyer undertakes to pay the Seller the agreed amount for the ordered goods and accept them.
3.4. The buyer undertakes to provide the complete and correct information in the payment form. If the Buyer provides inaccurate, false, or misleading data in the payment form, the Seller has the right to cancel the Buyer’s registration and delete the data.
3.5. In the event of a change in the Buyer’s data provided in the purchase form, the Buyer must immediately inform the Seller.
3.6. The Buyer has the right to withdraw from the Purchase and Sale Agreement following the provisions set out in the Return Policy.
3.7. Buyer, when placing an order in the e-store, agrees with the Terms and undertakes to comply with them and the established legal acts of the Republic of Lithuania.
4. Seller’s rights and obligations
4.1. The Seller undertakes to create all conditions for the Buyer to use the e-store services properly.
4.2. If the Buyer tries to damage the stability and security of the operation of the e-store or violates its obligations, the Seller has the right to immediately and without notice restrict, suspend or revoke the Buyer’s access to the e-store.
4.3. The Seller undertakes to respect the Buyer’s right to privacy of personal information belonging to the Buyer specified in the purchase form and not to transfer it to third parties, except for parties delivering the order for delivery, when required by the competent State authority in cases provided by the laws of the Republic of Lithuania.
4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
4.5. The Seller may, in essential circumstances, temporarily or permanently terminate the e-store without notifying the Buyer in advance.
4.6. The Seller may unilaterally change the Terms. If the Buyer uses the services provided by the e-store after these changes in the Terms, it is considered that the Buyer has agreed with changes of the Terms.
5. Ordering goods, prices, payment procedure, time frames
5.1. In the e-store, the Buyer can buy online 7 days a week, 24 hours per day.
5.2. All product prices in the e-store are in EUR, including VAT.
5.3. The buyer undertakes to pay for the order within 3 (three) calendar days from the date of order confirmation. The preparation of the parcel starts only after receiving the payment for the goods.
5.4. If the Buyer fails to make the payment within 3 (three) calendar days, the order will be canceled.
6. Delivery and return of goods
6.1. The buyer undertakes to indicate the exact place of delivery of the goods.
6.2. The buyer undertakes to accept the goods himself. If the Buyer cannot take the goods himself and the goods were delivered to the specified address, the Buyer shall not have the right to make claims to the Seller regarding the delivery of the goods to the wrong entity.

6.4. In all cases, the Seller is released from liability for non-compliance with the terms of delivery of goods if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer’s fault or due to circumstances beyond the Seller’s control.
6.5. The Buyer must immediately inform the Seller if the consignment is received in a damaged package if the consignment received unordered goods or their incorrect quantity, incomplete goods.
6.6. The buyer must provide the Seller with photos of the damaged parcel and/or product (s) via e-mail.
7. Quality of goods, guarantees
7.1. All details of the goods sold in the store are indicated in the product description attached to each product.
7.2. The quantities of goods shown in the e-store’s photos are not always related to the price of the goods – the price of more than one unit of goods may be displayed. The units of measurement are specified in the product description. The color of the goods may vary slightly depending on the monitor used by the Buyer.
7.3. The seller may provide an appropriate quality guarantee for individual types of goods, the specific term, and other conditions specified in the description of the goods.
8. Marketing and information
8.1. The seller can organize various promotions and offers in the e-store.
8.2. The seller has the right to unilaterally, without separate notice, change the terms of the shares, as well as cancel them. Any change or cancellation of the terms and conditions of the promotion shall take effect from the moment of their change or cancellation.
8.3. The Seller sends notifications to the Buyer to the e-mail address specified in the Buyer’s purchase form.
8.4. The Buyer sends all notifications and questions via e-mail contacts listed in the “Contacts” section of the store.
8.5. The Seller shall not be liable if the Buyer does not receive the sent information or confirmation messages due to internet connection, e-mail service provider network failures, messages entering the SPAM catalog or incorrect data provided by the Buyer.
8.6. The Buyer’s personal data may be processed for marketing purposes under the conditions specified in Clause 2.4 of these Rules.
9. Intellectual property
9.1. The seller owns all rights to the content of the website www.quted.com and has the exclusive right to use them. All trademarks, designs, names, logos, texts, photographs, and other elements available on www.quted.com are the Seller’s property.
9.2. Any copying and/or other use of the design, texts, photos, and other content elements of the www.quted.com website by third parties without the Seller’s written consent is a violation of copyright and other rights punishable under the laws of the Republic of Lithuania.
10. Final provisions
10.1. The Terms of Purchase and Sale of Goods have been drawn up following the laws and legal acts of the Republic of Lithuania.
10.2. The law of the Republic of Lithuania applies to these Rules. All disagreements arising from the implementation of the Terms shall be resolved through negotiations. If no agreement is reached, disputes are determined following the procedure established by the laws of the Republic of Lithuania.
